INSTITUTIONAL, QUALIFICATION, AND PROCEDURAL ASPECTS AFFECTING THE APPLICATION OF ARTICLE 6.1.1 OF THE CODE OF ADMINISTRATIVE OFFENCES OF THE RUSSIAN FEDERATION

Abstract:
The issue addressed in this article has long been in need of a scientifically grounded reevaluation. An analysis of the legal positions that determine the responsibility for battery in the Russian Federation, according to the current doctrine, suggests that the starting point is the accurate identification of the object of the illegal act. The article consistently presents the author's opinion on the institutional, qualification, and procedural nuances of administrative liability for beatings or other violent actions that cause pain to the victim but do not result in the consequences listed in Article 115 of the Criminal Code of the Russian Federation, and where there is no crime committed, in order to expand the existing understanding of these actions and contribute to the scientific discussion on the application of Article 6.1.1 of the Code of Administrative Offenses of the Russian Federation. The current situation requires an answer to the question of what is more important for Russian society: maintaining the industry-specific purity of criminal liability or achieving the necessary level of law enforcement efficiency based on a fair distribution of repressive resources. The complexity and insufficient development of ideas about administrative liability for offenses under Article 6.1.1 of the Code of Administrative Offenses of the Russian Federation have a negative impact on the effectiveness of the administrative legal norm on liability for battery and require a solid methodological basis.
